PREFACE


The « Skier + journée » loyalty programme is proposed by Deux Alpes Loisirs, SA, registered in the Grenoble trade and companies register under number: 064 501 406, and whose head office is located Résidence Le Meijotel 38860 Les 2 Alpes, France.


Deux Alpes Loisirs offers its customers a loyalty programme to reward their loyalty.


This document defines the conditions of eligibility and use of the loyalty programme proposed by Deux Alpes Loisirs, and sets out the rights and obligations of programme beneficiaries.


Joining this loyalty programme implies that programme beneficiaries have read and accepted the general terms of application of the said programme.


This document should therefore be read carefully by programme beneficiaries prior to joining.









DEFINITION


«Skier + journée » programme: loyalty programme proposed by Deux Alpes Loisirs concerning the ski passes issued exclusively by Deux Alpes Loisirs, enabling access to the 2 Alpes ski area. Eligible ski passes are valid between 1 and 3 days and this programme is not to be used in conjunction with any other discount or promotion proposed by Deux Alpes Loisirs or one of its partners.


Member : Private client who has joined the loyalty programme and purchased one or more ski passes.


Account : Materialisation of programme membership.




1-Programme description

Joining the programme enables members of the “journée” loyalty programme to earn discounts with each 1 to 3-day ski pass purchase, which can then be used for future ski pass purchases.


Ski pass purchases must be made at intervals of at least 4 days in order to be eligible for the discount. Discounts will only be earned by members purchasing ski passes via the www.skipass-2alpes.com website.


For purchases made at the resort, discounts will be applied once the purchases have been recorded at a specific sales desk.


2- Joining the loyalty programme


Membership can only be activated on the www.skipass-2alpes.com website.


Customers wishing to join the programme must therefore have Internet access and a valid email address.


Customers must fill in the on-line form in the « personal details » section of the www.skipass-2alpes.comwebsite. Customers must provide their surname, first name, email address, password and a postal address. Customers must specifically express their desire to join the « Skier + journée » programme by ticking a box.


Customers validate the information entered and confirm their membership by validating the account.


A web account will then be assigned automatically.


Membership implies acceptance of these terms of use of the « skier + journée » loyalty programme. After joining, the customer (person) will be considered as a member.


There are two possibilities for joining the programme.


If the customer purchases his/her ski pass via the www.skipass-2alpes.com website, he/she can join the programme upon validation of the order.


If the ski pass is purchased at a ski pass sales desk, the customer can join the loyalty programme afterwards at a specific desk. Proof of purchase and a valid ski pass must be presented.



Joining the programme is free, unrestricted and involves no obligation to buy.


Membership is limited to one login and password per person.


Only adult persons aged over 18 with the capacity to sign contracts may join the Deux Alpes Loisirs loyalty programme.


Minors (under 18s) and legal entities (companies, associations, etc.) are not eligible for the loyalty programme.




3- Programme principle


Members can earn discounts provided they identify themselves with their login and password.


4- Terms of discount acquisition


The discount earned is equal to 5% of the purchase.

Discounts earned by a member can only be used after 4 ski pass purchases and within the discount validity period.


Ski pass purchases eligible for discounts are defined as follows:


  • Ski passes issued exclusively by Deux Alpes Loisirs for the 2 Alpes ski area whose validity is between 1 and 3 days and which have been paid at list price (this offer is not to be used in conjunction with any other offer or promotion proposed by Deux Alpes Loisirs or one of its partners).


Purchases made via one of the Deux Alpes Loisirs points of sale concerning anything other than the sole acquisition of a ski pass valid for 1 to 3 days will not earn any discount.

Programme members may earn discounts once only for each purchase action.


5-Bonuses and special operations

It is agreed that the double-discount, i.e. 10% of the basket, granted by Deux Alpes Loisirs for activation of the member’s account, is valid only for the season during which the member joins the programme.


For special operations resulting in an increase of the discount rate applied, the discount rate will only be applicable for the duration of the operation.




6- Discount consultation


After joining the programme, members can consult the amount of discount earned on the www.skipass-2alpes.com website.


Only the total amount of discounts earned shown on this account is considered legally binding.


Upon request, or at least once during the current season, notification of the amount of discount earned will be sent to the member.


Furthermore, members can print out a statement showing the amount of discounts earned directly via the www.skipass-2alpes.com website.


Insofar as these discounts are processed automatically by the IT systems, there may be a difference between the statement sent and the amount indicated on the member’s web account.


In any case, such data is sent for informational purposes only and only the amount indicated on the member’s web account on the www.skipass-2alpes.com website is considered legally binding.




7- Use of discounts


Members may use their discounts from their 5th ski pass purchase. An immediate discount will then be applied to the purchase of a ski pass.


The amount of the reduction will depend on the discounts earned on the member’s account. Discounts may not exceed the total purchase amount. Any further discount will be left as credit for a future purchase.



8- Offer recommendation

Members have access to an offer recommendation system for Deux Alpes Loisirs ski passes. This system, which works via email, enables members to recommend a marketing offer to another person. If the recommendation generates an immediate and/or exclusive sale via the hypertext link in the recommendation email, the member will earn an additional discount towards his/her future purchases.



This discount will be equivalent to 2% of the basket generated.




9- Sharing and transferring discounts

Discounts earned by a member on his/her web account are for the sole benefit of the member. However, the discounts earned a web account can be used for the benefit of skiers directly associated with the account.


Discounts may not be transferred, shared or sold to another third party.


Any fraudulent use of the discounts earned on a member’s account will result in immediate cancellation of the account.

Deux Alpes Loisirs reserves the right to demand compensation before the competent jurisdiction.




10- Discount validity

Membership of the loyalty programme is not limited in time.

The discounts earned by a member on his/her account are valid for three years, starting from the date of joining the loyalty programme.

Discounts earned on the member’s account are directly related to the existence of the loyalty programme.


11 – Deux Alpes Loisirs’ liability


Deux Alpes Loisirs undertakes to ensure that members can use the discounts they have earned. This implies no more than an obligation of means.


Deux Alpes Loisirs cannot be held liable for any prejudice suffered because of:


- fraudulent use of the member’s account, login or password on the www.skipass-2alpes.com website,

- exceeding the validity date of the discounts earned,

- malfunction of the IT system used by the member to access the loyalty programme,

- failure to access the www.skipass-2alpes.com website,

- fraudulent use of the discounts earned.


In general, DEUX ALPES LOISIRS cannot be held liable for any direct or indirect consequences of membership or use of this loyalty programme.


The www.skipass-2alpes.com website may propose links to other websites which do not belong to the DEUX ALPES LOISIRS group. However, DEUX ALPES LOISIRS cannot be held liable for the content, products, advertising, services or goods available via such sites.


Similarly, DEUX ALPES LOISIRS cannot be held liable for any prejudice suffered that originates from the use of such links to other websites.



12- Obligations and responsibilities of the member


Members accept to receive emails from DEUX ALPES LOISIRS concerning the « skier + journée » loyalty programme.

Members retain sole responsibility for the use of their login/password and any resulting consequences. Members undertake not to disclose this information to other persons.


Failing this, Deux Alpes Loisirs cannot be held liable in the event of fraudulent use of the account, login or password.




The member undertakes:


- not to use the « Skier + journée » loyalty programme illegally,

- not to pass on messages liable to infringe upon public order and common decency or to incite discrimination or suicide; or messages whose content is insulting, defamatory, racist, xenophobic, revisionist; or whose content may affect the private life of a third party, the freedom, dignity, honour and/or reputation of others,

- not to use the loyalty programme fraudulently,

- not to pass on viruses via the www.skipass-2alpes.com website.




13- Modification of the loyalty programme


Deux Alpes Loisirs reserves the right to modify its loyalty programme at any time, provided its members are informed by email and by information posted in the resort itself. Any such modifications shall be legally binding in replacement of the previous general terms of use of the loyalty programme.


In any case, the amount of discounts already acquired on the date of modification may not be altered.


Should the loyalty programme be suspended or interrupted for any reason whatsoever, Deux Alpes Loisirs would not be held responsible for the consequences of this suspension or interruption.


14- What to do if you lose or forget your login and password


If a member loses or forgets his/her password, the login can be used to access the website. DEUX ALPES LOISIRS will then send a message to the email address indicated enabling the member to change his/her password.



Deux Alpes Loisirs cannot be held responsible for use of the account between the loss/forgetting of this information and the declaration made by the member.




15- Termination of the loyalty programme


15.1 – Members can terminate their membership of the loyalty programme by notifying Deux Alpes Loisirs by registered letter with acknowledgement of receipt to the address indicated below:

15.2 - Deux Alpes Loisirs reserves the right to terminate the loyalty programme at any time, for any reason whatsoever, except those mentioned in part 15.3.


Deux Alpes Loisirs will inform members as quickly as possible either by registered letter with acknowledgement of receipt, or by email or by posting messages around the resort.


In this case, members may use any discounts they have earned for the rest of the current season or for one month of the season following termination of the programme.


In order to be able to use the discounts earned, the member must have reached the minimum level of use of his/her account.



15.3 –Deux Alpes Loisirs may terminate membership of the loyalty programme on its own initiative, in full accordance with the law, without prior notification and without any counterpart of any kind, by way of registered letter with acknowledgement of receipt in any of the following situations:


  • in the event of the member’s death,

  • if the account remains inactive for three years,

  • in the event of breach of the general terms of use of the « Skier + journée » loyalty programme,

  • in the event of abusive or fraudulent use of the programme by a member or a third party acting on behalf of a member.

  • if a member creates several accounts,

  • if the member fails to notify of any changes regarding his/her personal information,

  • if the member is already a member of the « Skier + séjour » loyalty programme,

  • in the event of breach of the general terms of use,

  • in the event of abusive or fraudulent use of the programme,

  • if the member fails to keep his/her information exact and up to date,

  • if a legal, regulatory or jurisprudence ruling having a significant effect on the loyalty programme or making it illegal is passed,


The advantages acquired will be cancelled without compensation of any kind, except in the event of a member’s death.


Members may be required to pay the costs of any damages, compensation and legal proceedings except in the event of death.


In the event of death, the deceased’s family (spouse and descendents) may inherit the remaining discounts until the end of the current season and over a period of one month of the season following the demise.



16 - Claims concerning the amounts of discounts awarded


Only the total amount of discounts earned shown on the member's account is considered legally binding.

However, members may send a written claim to DEUX ALPES LOISIRS, at the following address, in the event of disagreement:

This claim must include the following information:

  • full contact details (first name, surname, address, postcode, city),

  • the account statement printed off the website,

- the proof of purchases made eligible for discounts.

Deux Alpes Loisirs will then check the items sent by the member.

If upon verification, it appears that the error can be imputed to Deux Alpes Loisirs, the latter undertakes to credit the member’s account as quickly as possible in order to enable him/her to use the discounts earned towards subsequent purchases.


17 – Modification of a member's personal details


Any changes to a member’s personal contact details must be communicated to Deux Alpes Loisirs as quickly as possible.




18- Personal information and the Data Protection Act


Nominative data/B>


Deux Alpes Loisirs collects data for enrolment in the loyalty programme.



The automatic processing of nominative data carried out for the needs of this programme has been declared to the authorities. The national commission for data protection has granted its authorisation under no. (APPLICATION IN PROGRESS).


Nominative information recorded during enrolment in the « Skier + journée » programme will not be used for any purposes other than management of the said programme.


This nominative information may also be used for direct marketing operations or operations initiated by one of DEUX ALPES LOISIRS’ partners, such as Deux Alpes Voyages. It may also be passed on to other partners of DEUX ALPES LOISIRS, such as Deux Alpes Voyages, for the sole purpose of use of the www.skipass-2alpes.com website.


Without express authorisation from the member, the personal data collected may not be transferred to any third party that is not a partner of DEUX ALPES LOISIRS, except in the case of legal or regulatory obligations.


In compliance with the Data Protection law no. 78-17 dated January 6th 1978, members have the right to access, modify, rectify and oppose any information provided upon enrolment in the « journée » loyalty programme.

In the event of termination of loyalty programme membership, any nominative data collected directly or indirectly will be erased automatically.




19- Terms of use of the member ski pass

When using a ski pass in the 2 Alpes ski area, members’ ski passes may be verified by Deux Alpes Loisirs’ officials. For any such verification, the member or associate of the member must provide proof of his/her identity by presenting photo ID, mentioning the full name of the ski pass user.



20 – Applicable law and attribution of jurisdiction


The general terms of use of the “journée” loyalty programme are governed by French law. Any claims arising from the interpretation, opening, use or termination of membership in this loyalty programme will be brought before the competent court.

15- Termination of the loyalty programme

This claim must include the following information:

  • full contact details (first name, surname, address, postcode, city),

  • the account statement printed off the website,

- the proof of purchases made eligible for discounts.

Deux Alpes Loisirs will then check the items sent by the member.

If upon verification, it appears that the error can be imputed to Deux Alpes Loisirs, the latter undertakes to credit the member’s account as quickly as possible in order to enable him/her to use the discounts earned towards subsequent purchases.

17 – Modification of a member's personal details


Any changes to a member’s personal contact details must be communicated to Deux Alpes Loisirs as quickly as possible.



18- Personal information and the Data Protection Act


Nominative data


Deux Alpes Loisirs collects data for enrolment in the loyalty programme.


The automatic processing of nominative data carried out for the needs of this programme has been declared to the authorities. The national commission for data protection has granted its authorisation under no. (APPLICATION IN PROGRESS).


Nominative information recorded during enrolment in the « Skier + Séjour » programme will not be used for any purposes other than management of the said programme.


This nominative information may also be used for direct marketing operations or operations initiated by one of DEUX ALPES LOISIRS’ partners, such as Deux Alpes Voyages. It may also be passed on to other partners of DEUX ALPES LOISIRS, such as Deux Alpes Voyages, for the sole purpose of use of the www.skipass-2alpes.com website.


Without express authorisation from the member, the personal data collected may not be transferred to any third party that is not a partner of DEUX ALPES LOISIRS, except in the case of legal or regulatory obligations.


In compliance with the Data Protection law no. 78-17 dated January 6th 1978, members have the right to access, modify, rectify and oppose any information provided upon enrolment in the «Skier + séjour » loyalty programme.

In the event of termination of loyalty programme membership, any nominative data collected directly or indirectly will be erased automatically.




19- Terms of use of the member ski pass

When using a ski pass in the 2 Alpes ski area, members’ ski passes may be verified by Deux Alpes Loisirs’ officials. For any such verification, the member or associate of the member must provide proof of his/her identity by presenting photo ID, mentioning the full name of the ski pass user.




20 – Applicable law and attribution of jurisdiction


The general terms of use of the « séjour » loyalty programme are governed by French law. Any claims arising from the interpretation, opening, use or termination of membership in this loyalty programme will be brought before the competent court.
